1. Agreement to Terms

Welcome to ITankU ("we," "us," or "our"). By accessing or using our website at itanku.org and any related services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.

These Terms constitute a legally binding agreement between you and ITankU regarding your use of the Platform. By creating an account, accessing or using any part of our services, or clicking to accept these Terms, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Description of Service

ITankU is a community platform that facilitates the transfer of fuel assistance between users. Our Platform enables:

Givers to send monetary fuel assistance to designated recipients
Recipients to submit requests for fuel assistance
Recipients to redeem fuel vouchers at participating gas stations

ITankU acts as an intermediary facilitating transactions between users. We are not a financial institution, payment processor, or gas station operator.

3. Eligibility

You must meet the following requirements to use our Platform:

Be at least 18 years of age or the age of majority in your jurisdiction
Have the legal capacity to enter into binding contracts
Not be prohibited from using the Platform under applicable law
Provide accurate, current, and complete information during registration

By using the Platform, you represent and warrant that you meet all eligibility requirements.

4. User Accounts

To access certain features, you must create an account. You are responsible for:

Maintaining the confidentiality of your login credentials
All activities that occur under your account
Notifying us immediately of any unauthorized use
Providing and maintaining accurate account information

We reserve the right to suspend or terminate accounts that violate these Terms or engage in prohibited activities.

5. Acceptable Use

You agree NOT to use the Platform to:

Violate any applicable law, regulation, or third-party rights
Submit false, misleading, or fraudulent requests for assistance
Use the Platform for commercial purposes unrelated to fuel assistance
Attempt to manipulate, abuse, or exploit the Platform or its users
Interfere with the proper functioning of the Platform
Collect or harvest user information without consent
Transmit viruses, malware, or other harmful code

6. Transactions and Payments

For Givers: When you send fuel assistance through ITankU, you authorize us to process your payment and transfer the designated amount to the recipient's fuel voucher. All transfers are final and non-refundable unless required by law.

For Recipients: Fuel vouchers are provided by community members and have no cash value. Vouchers may only be redeemed at participating gas stations and are subject to the terms of each station.

ITankU does not guarantee the availability, timing, or fulfillment of any fuel assistance request. We do not process payments directly but facilitate transactions through third-party payment processors.

7. Privacy

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy. By using the Platform, you consent to our data practices as described in the Privacy Policy.

8. Intellectual Property

The Platform and its original content, features, and functionality are owned by ITankU and are protected by international copyright, trademark, patent, and other intellectual property laws. You retain ownership of content you submit but grant us a license to use it as described in our Privacy Policy.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
Warranties that the Platform will be uninterrupted, secure, or error-free
Warranties regarding the accuracy, reliability, or completeness of content
Warranties regarding the availability or quality of fuel at partner stations

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ITankU AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or use, incurred by you or any third party
Damages resulting from your use of or inability to use the Platform
Any transaction or dispute between users or with third parties

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS SHALL NOT EXCEED $100 USD.

11. Indemnification

You agree to indemnify, defend, and hold harmless ITankU and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms.

13. Termination

We may terminate or suspend your access to the Platform immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination shall survive.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Delaware for resolution of any disputes.
